When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

In order to make our Service more useful to you, we collect information about you, your household (but not children under 13, or children 13-18 without the permission of the legal guardian), and your use of your music collection. This Privacy Policy, as amended from time to time, describes how we collect information from you, how we handle that information, and how we use that information. This Privacy Policy is part of our Terms of Service and applies to all information we collect or receive from you and your household.

INFORMATION WE COLLECT


In order to improve the usefulness of our MusicGiants Network Software, we collect the following information:

Registration Information. In order to use our Software and/or to sign up for our mailing list, you must provide us with certain personal information. Prior to using our Software for the first time, you will be required to register and create an account with MusicGiants (“MusicGiants Account”). When you create your MusicGiants Account, you will be required to provide a login name and password and your name, address and email address. You may also be asked to provide us with additional information, such as your age, gender, and other personal information about yourself or your family. In addition, prior to purchasing the right to use music or other content from us, you will also be required to provide your credit card information and your billing address. We may retain your credit card information in our database to facilitate your checkout process for future transactions. You may also be asked to provide us with additional optional information, such as your age, occupation, and internet service provider, but such information is not required.


As part of the process to create a MusicGiants Account or to participate in certain promotions offered by MusicGiants such as entering sweepstakes, contests, surveys, newsletters, etc., in addition to name, address, and email address, you may be asked to provide certain information which, by itself, does not personally identify you. For example, you may be asked to provide information concerning your music or other entertainment preferences, purchasing habits, and the like. MusicGiants may request this information in order to enhance your experience by understanding you better and to also make you aware of new services, programs or offers in which you may be interested.


MusicGiants.com & MusicGiants Network Software. We keep track of the domains from which people visit our Website, www.MusicGiants.com. We may track the country or zip code of visitors to our Website and of those downloading or attempting to download our MusicGiants Network software. We analyze this data for trends and statistics, and for federal export law compliance when required. This information is analyzed at an aggregate level and is not considered personally identifiable. We also collect statistical data on all users of our Website, including: the Internet Protocol (IP) address of the user’s computer, the referring URL, if any, and the browser software identification. Certain referring URLs and IP addresses may contain or suggest personally identifiable information.

Mailing Lists


In order to keep you informed about our services, we may send e-mails and announcements that are needed for the administration of our Website and service. We also give our users the option of joining our mailing list to receive additional information about our Website, services and offers.

If you have registered with us, we collect information about what music files you possess on the PC you use to sign up with our service and any other PC’s networked to that PC. We also collect information regarding where you obtained that music. We may collect information concerning licenses to access music obtained from third party providers. We collect information concerning the bit rate of the encode of music files contained on your PC and/or any PC connected to that PC. We collect information about what authorized MusicGiants’ reseller (“AMGR”) or custom installer (“CI”) referred you to our service. We use this information as a means to track your purchases so we can pay that AMGR or CI commissions on our sales to you. We collect information as to who provides you with service or support for your audio/video systems. We use this information to make sure you have a qualified service person explaining how to use our service. If you tell us you do not presently have a customer/client relationship with a CI or AMGR, we will collect that information. We may use that information to refer a CI or AMGR to you. If we provide you the name, address or telephone number of a CI or AMGR in your area, we are doing so as an accommodation to you. We expressly disclaim any warranty as to the efficacy of using that CI or AMGR. You are free to use any custom installer you wish.

Cookies


When you visit our Website or click through hyperlinks appearing thereon, or use one or more of our services, we may use an industry-wide technology called “cookies” which stores certain information on your computer and which will allow us to customize your experience to better match your interests and preferences or simply facilitate your signing-in to use the services. Most browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. MusicGiants Download Manager. Before you can download music from us, you must download our MusicGiants Network software application. This software performs many functions, including managing downloads you obtain from us. In order to make sure the MusicGiants Network software is functioning properly and to add functionality, we may periodically send the MusicGiants Network software updates, fixes or support files. Once it has been downloaded to your computer, the MusicGiants Network software will keep track of your transactions on our service and of your usage of our service, and share such information will be sent to our servers in Los Angeles and elsewhere.

Security Software. The MusicGiants service works in conjunction with your third party supplied media player (see minimum specifications) which, among other things, protects against unauthorized use, including copying, of the downloaded digital files that you obtain from us with limited rights of Service. The security on the media player software may need to be upgraded by the third party suppliers, which currently include, but may not be limited to, Microsoft Corporation. Your media player will connect to an Internet site operated by those third party suppliers, and will be sent a security file, along with a unique identifier, which does not contain any personal information about you. The third party supplier’s use of this information is subject to such third party supplier’s privacy policies which can be accessed from its website.

WHAT WE DO WITH YOUR INFORMATION


In general, MusicGiants may use non-personally identifiable information about you to improve and enhance the services we provide. MusicGiants may share this information with the suppliers of content on the service, affiliates and other entities in non-personal form to show general demographic and preference information among users of the MusicGiants service or for other purposes. This information may include usage and demographic data, but it will not include personal information (such as your email address). If you provide MusicGiants with personally identifiable information, we will take reasonable and appropriate steps to protect this information. Except as otherwise described in this Privacy Policy, our Terms of Service and in our Sales Policy, MusicGiants will not disclose, share, sell or rent personally identifiable information collected on our Website to any third party without your prior consent. We do not share your credit card account information with CIs or AMGR or any other third parties, other than order processing and credit card clearance service providers as described below.


We work with third parties who provide services, which may include website hosting, promotion fulfillment, order processing, credit card clearance, data analysis, customer service and other services of an administrative nature. Personal information, including financial information, may be shared with such third parties for the purpose of providing such services to you. We seek to impose confidentiality obligations on such service providers. SECURITY


We use reasonable security methods to protect the data that resides on our servers. However, because no security system is impenetrable, we cannot guarantee the security of our servers. It is also possible that information you supply to us will be intercepted during transmission.


Whenever you give MusicGiants sensitive information (e.g., credit card numbers), MusicGiants will take commercially reasonable steps to protect such information by establishing a secure connection with your Web browser. MusicGiants employs an industry standard technology known as a secure-socket-layer (“SSL”) to protect the transmission of payment information from the MusicGiants Network to our servers.

To help protect your MusicGiants Account information, please keep your password secure. We suggest that you pick a non-obvious password that mixes numbers and letters. In addition, we recommend that you do not divulge your password to anyone. Ultimately, you are responsible for maintaining the secrecy of your passwords and any MusicGiants Account information.


Remember to sign out of your MusicGiants Account, and close your browser window whenever you leave your computer, SoundVault, or other device running the MusicGiants Network software. This is to ensure that others cannot access your personal information, because your computer may be accessible to others or used in a shared setting. MusicGiants’s Privacy Policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond MusicGiants’s control, and is not to be applied in any manner contrary to applicable law or governmental regulation.


LINKS TO OTHER SITES


Linking to other sites is an integral part of the functionality of the Internet, including our Website and our service. Any link to a page that displays a URL other than a domain name that contains MusicGiants.com in the address window of your browser is a link to a site outside of our service and thus outside the control of MusicGiants. This includes links to our suppliers of content on the service, affiliates, and links to any other advertisers and third parties that may be linked to MusicGiants. MusicGiants particularly recognizes the sensitivity of personal information concerning children under the age of 13 and therefore provides this special notice to the parent(s) or guardian(s) regarding the collection and use of information collected from children in this age group. The Website and the services provided thereon are intended for access and use strictly by adults over 18 years of age and persons ages 13-18 with the consent of their parent or guardian. HOW TO REVIEW, UPDATE OR DELETE YOUR REGISTRATION INFORMATION

As part of your use of our services, you are responsible for updating your submitted registration information so that it is current, accurate, and complete. In order to update your registration information, please access your MusicGiants Account and make the desired change. You may also access your MusicGiants Account in order to change your user preferences.
